CENTRAL UNITED "ACTUAL CHARGES" CLASS ACTION INFORMATION
Central United and two of its cancer insurance policyholders entered into a proposed national class action settlement in the Circuit Court for Mobile County, Alabama, regarding Central's payment of chemotherapy, radiation and blood-related benefits on an "actual charges" basis. The proposed settlement covers all cancer policies sold, assumed and/or administered by Central United which contains "actual charges" language in the chemotherapy, radiation and blood benefits provisions. The proposed settlement sets June 3, 2008, as the deadline for policyholders to accept the proposed settlement, to object to the proposed settlement, or to exclude yourself from the settlement.
Our law firm has been litigating cancer insurance cases against Central United for years, including "actual charges" cases. In our opinion, the proposed settlement is not fair or reasonable, and does not provide adequate compensation to the affected policyholders. We base our opinion, in part, on several recent court cases and opinions which have held in favor of the policyholders on the "actual charges" issue, and against Central's position. The Class Action Notice you received in the mail does not discuss these important court opinions and jury decisions to assist you in making an informed decision; however, we are here to tell you about them because they are very important to your decision regarding this proposed settlement.
We are here to answer any questions you have about the proposed settlement, and if you decide to exclude yourself from the settlement, we can discuss representing you in your own lawsuit against Central United to obtain the full benefits to which you are entitled. Please call us toll-free at 1-888-725-2477 or email Attorney Stan P. Baudin at sbaudin@pbclawfirm.com to discuss the proposed settlement and your options.
Remember, you must take action by June 3, 2008, so do not delay. Your benefits under your policy will be reduced if you do not take action and this proposed settlement is finally approved by the court.
