Fentanyl Pain Patch Litigation

Studies have been conducted suggesting that health care providers and patients should be aware that deaths and other serious problems have resulted from accidental overdoses related to use of the fentanyl patch caused by a manufacturing defect in the product.

Fentanyl is a pain medication that is approximately 80 times more potent than morphine and is generally used for people who experience chronic pain, and who have been taking pain medications for extended periods of time.  However, just recently, these pain patches have been used for short-term or acute pain.  For years, the Duragesic pain patch manufactured by Johnson & Johnson was the only fentanyl patch on the market.  Since this time, generic versions of the patch have been manufactured by Sandoz, Mylan, Alza, Watson and Actavis.

Over the past several years, the manufacturers of these pain patches have recalled hundreds of thousands of fentanyl patches due to defects that can cause serious injury and death.  The most recent recall occurring on December 31, 2008.  In addition, the FDA is investigating hundreds of deaths and overdoes that have occurred with the use of the fentanyl pain patches.  Since July of 2005, the FDA has issued numerous public health advisories on the product.
