Local Louisianan Files Class Action Suit Against Mississippi Company Over Rusted Roof

East Baton Rouge Parish, Louisiana, April 12, 2007 - Patrick G. Welch, resident of Livingston Parish, Louisiana, filed a federal class action law suit today on behalf of a class against Atlas Roofing Corporation of Meridian, Mississippi.
The suit alleges Atlas Roofing Corporation violated the Louisiana laws of redhibition and the Louisiana Product Liability Act ("LPLA") when they designed and manufactured defective shingles then sold them for both business and residential use. Atlas Roofing Corporation manufactures both commercial and residential building materials, including roofing shingles, sold in Louisiana and throughout the United States.
Welch replaced his old shingles with roofing shingles manufactured by Atlas when he changed the roof on his home. Shortly after installing the shingles, Welch noticed they were rusting and causing the sides of his house and surrounding areas to stain in a rust color.
The shingles manufactured by Atlas contained non-rust resistant metal fragments causing them to rust and prematurely break down leading to rust stains on the structures where these shingles are used. Despite knowing the shingles are defective, Atlas has never issued a recall or any other type notice to consumers about the product's defects.
Welch is alleging that Atlas of continued to market and sell a product it knew was defective. Plantiffs are seeking return of the purchase price for the roofing shingles along with interest accrued since the time the purchase price was paid, reasonable expenses occasioned by the sale as well as damages caused by the use of the defective shingles for all consumers who purchased the product for business or residential use.
